Woman Settles Florida Slip and Fall Case After Husband’s Death

SlipFallCase_

A widow has finally gotten justice after her husband’s slip and fall and subsequent death. The 75-year-old man was using a walker at an Ocala restaurant several years ago when he got snagged and fell to the ground. The man died 11 months later, before his case could be settled.

Now, two years after the man’s death, it has been discovered that his widow settled the case in October 2025. Following his death, his widow continued the legal battle against the defendant, Harry’s of Ocala, LLC, which does business as Harry’s Seafood, Bar & Grille.

The two parties engaged in mediation throughout 2025, with a notice of settlement filed on October 24, 2025, more than two years after the case was first brought before the Fifth Judicial Circuit Court of Marion County.

The widow filed a voluntary dismissal with prejudice on December 1, 2025. While the specific financial terms of the agreement were not disclosed, this action closed the case for good.

The man was seeking more than $50,000 in damages after the slip and fall accident, which took place at Harry’s Seafood, Bar & Grille on 1st Avenue in downtown Ocala on May 5, 2023. The man was using a walker when it slipped on a doormat, causing him to be “violently thrown to the ground.”

As a result, the man suffered multiple damages, including permanent injuries, hospitalization expenses, medical and nursing care and treatment, lost wages, and an inability to earn income.

The man passed away on April 3, 2024. At that time, his wife took over as the representative of his estate.

Slips and Falls in Restaurants

Slip-and-fall accidents in restaurants are more common than many people realize. These incidents typically fall under premises liability law, meaning the restaurant may be responsible if it failed to maintain a reasonably safe environment.

Restaurants have a unique set of hazards, including:

  • Wet or greasy floors (from spills, mopping, or food prep).
  • Dropped food or drinks that aren’t cleaned up quickly.
  • Poor lighting that makes hazards harder to see.
  • Uneven flooring or loose tiles.
  • Cluttered walkways, especially in busy dining areas.
  • Weather-related hazards like rainwater tracked inside.

Slip-and-fall accidents can cause injuries such as:

  • Broken bones (especially wrists, hips, or ankles).
  • Head injuries or concussions.
  • Back and spinal cord injuries.
  • Soft tissue damage like sprains and tears.
