Florida Woman Sues After Fall at Winn-Dixie

We often do not think about the ramifications of going to the store or running any other errand. For many people, grocery shopping is part of their weekly routine. However, we are never safe. Dangers can lurk anywhere. A slippery floor can lead to a nasty fall and serious injuries.

This recently happened to a Belleview woman. She has filed a negligence lawsuit against Winn-Dixie Stores, LLC, alleging she suffered serious and lasting injuries after slipping and falling in the grocery store’s freezer aisle.

According to court records, the lawsuit was filed on January 16, 2026, in the Fifth Judicial Circuit Court of Florida in Marion County. The woman claims the incident occurred on or about August 5, 2025, inside the Winn-Dixie located at 11310 U.S. Highway 301 in Belleview.

The complaint alleges that the woman slipped on a liquid substance that had accumulated on the floor in the freezer aisle, causing her to fall. She contends the condition was dangerous and should have been discovered and addressed by store employees before the accident occurred.

In the lawsuit, the plaintiff accuses Winn-Dixie of failing to properly maintain the premises in a reasonably safe condition, failing to conduct adequate inspections, and failing to clean up or remedy the hazardous condition in a timely manner. The complaint also alleges the store failed to warn customers of the danger, despite knowing or having reason to know that liquid buildup in freezer areas can pose a slipping hazard.

As a result of the fall, the woman claims she sustained significant bodily injuries, along with ongoing physical pain, impairment, and emotional distress. The lawsuit states that she has incurred medical expenses and may continue to require future medical treatment. She also alleges lost income and a diminished ability to enjoy daily life, with some injuries described as permanent or continuing in nature.

The woman is seeking damages in excess of $50,000, exclusive of interest, costs, and attorneys’ fees. She has also requested a jury trial.

Court records indicate that Winn-Dixie was formally served with the lawsuit on January 23, 2026. As of the most recent filing, the company has not yet submitted a response or answer to the allegations.

The lawsuit comes after a woman has filed a lawsuit against Winn-Dixie over an incident that happened to a different store in the area. The woman was visiting the Winn-Dixie located at 11310 SE Nathan Mayo Highway in Belleview on September 22, 2025. She claims she lost her balance, fell, and sustained serious injuries after a wheel on her shopping cart allegedly jammed.
