Publix Slip and Fall Leads to $4 Million Verdict for Florida Woman

A Central Florida woman who slipped and fell inside a Publix Super Markets store nearly three years ago has been awarded almost $4 million in damage.

The lawsuit was filed by a woman who was shopping at a Publix location on North John Young Parkway in Kissimmee in June 2023. That was when she slipped on a liquid substance in the store’s soft drink aisle. According to court documents, the spill created a dangerous condition that caused her to suffer severe and permanent injuries.

The lawsuit is accusing Publix of negligence, arguing the company failed to maintain safe conditions for customers.

In February, a jury found Publix fully responsible for the woman’s injuries and awarded her a total of $3.967 million in damages. The award included $411,000 for past medical expenses and $556,000 for future medical costs. The jury also awarded $750,000 for past pain and suffering, disability, physical impairment, disfigurement, mental anguish, inconvenience, and loss of enjoyment of life. There was an additional $2.25 million for those same damages expected in the future.

Publix has since filed a motion requesting a new trial, claiming the court improperly allowed evidence related to inflated medical bills during the proceedings. The company argues that the evidence presented exceeded limits set under Florida negligence law and unfairly influenced the jury’s decision regarding both economic and non-economic damages.

As an alternative, Publix is asking the court to reduce the award for past medical expenses to just under $34,000, contending that amount more accurately reflects the damages permitted under state law.
