What Are Some Types Of Premises Liability Claims?


When people think of premises liability accidents, slips and falls come to mind, and for good reason. Slips and falls are very common, accounting for more than 8 million hospital emergency room visits every year.

However, slips and falls are not the only type of premises liability claim. Any kind of unsafe behavior or actions on another person’s property can lead to injuries.   • Water leaks or flooding. Excess water can also make the ground slippery and cause someone to lose their footing and suffer serious injuries.
  • Inadequate maintenance/defective conditions of the premises. When flooring is ripped up, steps are uneven, a balcony is falling apart, or some other issue in a property is in need of repair, and the owner fails to make the necessary repairs, it can cause serious injuries.
  • Elevator and escalator accidents. When these mechanisms fail due to a lack of maintenance, and someone is injured, the property owner may be at fault.
  • Dog bites. Dogs involve an unsafe condition, and therefore fall under premises liability. Dog bites can cause a variety of injuries, such as broken bones, facial trauma, scarring, disfigurement, and even death.
  • Swimming pool accidents. Many accidents can happen in or around pools. Besides drowning, a person can be injured by diving boards and slides. Electrical defects and slips and falls can also occur.
  • Amusement park accidents. Due to the fast motion of amusement park rides, many can cause head, neck, and back injuries. They can also cause strokes, brain injuries, aneurysms, and broken bones. Many riders have fallen off rides and even died.
  • Assault and battery. When poor lighting or negligent security causes someone to get assaulted, the property owner can be held liable for this and other crimes that take place on the property. This is especially true if the property has a history of crime and does not warn guests or residents.
